The Litigation Process

LITIGATION When divorcing parties cannot come to an agreement on their own, the matter is taken to court. Prepare and Sign Court Documents 3 documents must be prepared: (a) The Initiating Application sets out what orders you wish the court to make, both by way of interim orders and final orders. (b) A Financial Statement if you are seeking property or spousal maintenance orders (not required in most parenting-only cases). File The three documents are filed with the Court which then fixes the matter for a preliminary hearing referred to as a Case Assessment Confer- ence or a first return date depending on whether the matter is issued in the Family Court or the Federal Magistrates Court. Duty List Hearing The Federal Magistrate may: - give directions (instructions on the next step/s required in a case) - approve proposed consent orders - if time permits, conduct an interim hearing (a short hearing about an urgent or defined issue) and make in terim orders - make final orders for certain types of applications - set a date for a final hearing 21 Case Assessment Conference This is a chance for the parties to reach an agreement on financial issues with the help of a registrar. - Points of disagreement and facts of the case will be assessed. - Additional information may be requested of the par- ties. - If appropriate, other services may be recommended to settle the dispute.
