IMPAIRED DRIVING The terms DUI and DWI are commonly used today to refer to the charge of Impaired Driving as named under s.253(1)(a) of the Criminal Code. The use of these terms seem to remain due to use in popular culture. FACTS ON DRINKING & DRIVING Over the last five years, there have been 42,913 criminal convictions for impaired driving in Alberta (April 1, 2009 - March 31, 2014). 42,913 Convictions in 5 years RULES AROUND DRINKING & DRIVING As of 2002, Alberta introduced new rules around drinking and driving. Drivers caught with a blood alcohol concentration over .05 but less than the .05 - .08 Criminal Code limit of .08, will have their licence suspended and their vehicle impounded for three days. DRINKING & DRIVING PENALTIES Stiff penalties including suspended licenses, fines and even jail time can result from drinking and driving. In most cases a first offender will receive a fine and a one-year driving prohibition. If you are convicted and have a prior Criminal Record for a similar type of offence, there are mandatory minimum jail terms and increased driving prohibitions. YOU ARE INNOCENT UNTIL PROVEN GUILTY Impaired Driving incidents account for the most common adult criminal court cases in Canada. If you are convicted of Impaired Driv- ing it can affect your ability to travel; in some cases you may be denied entry into the United States. You can be charged with impaired driving in a car, on ATVS, while boating and while operating any other motorized vehicle.
