Drivers caught with a blood alcohol concentration over .05 but less than the .05 - .08 Criminal Code limit of .08, will have their licence suspended and their vehicle impounded for three days. DRINKING & DRIVING PENALTIES Stiff penalties including suspended licenses, fines and even jail time can result from drinking and driving. In most cases a first offender will receive a fine and a one-year driving prohibition. If you are convicted and have a prior Criminal Record for a similar type of offence, there are mandatory minimum jail terms and increased driving prohibitions.
