Family Court cannot grant divorces. NY Supreme Court NY Family Court For All Divorces, the parties involved must meet these residency requirements: The parties were married in NY, and either spouse was a resident for 1 year prior to the filing of the divorce. The couple lived as husband and wife in NY and either spouse was resident for 1 year prior to the filing of the divorce 3 The grounds for the divorce occurred in NY, and either spouse lived in NY for 1 year prior to the filing of the divorce The grounds occurred in NY, and both parties are residents at the time the divorce started Either spouse lived in NY two years prior to the filing of the divorce All divorces need to have grounds The following are acceptable grounds for divorce: Irretrievable breakdown - relation- ship has broken down for at least 6 months. This is no fault divorce. This is the most common. Cruel and inhuman treatment - 2 your physical and mental health is in danger Abandonment - your spouse abandons you for at least one year Imprisonment - spouse is in jail for 3 or more 4 years - requires a witness, and there are restrictions Separation Agreement or Decree - legally separated for a year, then 6. convert to a divorce There are two types of divorce one can file for Contested Divorce And Uncontested Divorce Uncontested Divorce: The parties agree on the legal grounds for the divorce, and all of the issues that arise in a divorce. The issues are: Equitable distribution Child custody Child support Visitation Maintenance In an uncontested divorce, the NY divorce attorney will draft all of the divorce documents and file them with the court. Depending on the terms of the agreement, the parties may want a written agreement filed with the court and submitted with the uncontested divorce package. There are no court ap- pearances, and the attorney does all of the work for you. In an uncontested divorce the par- ties control the outcome of the case. Co htested vorce: The parties do not agree on the grounds, and/or some or all of the issues that arise in a di- vorce. Unlike an uncontested divorce where the parties control the outcome, in a contested divorce the Judge controls the outcome of the case.
