State of the (GAY) Union SAME-SEX MARRIAGE IN THE U.S. IN 2013* 2013 saw seven states legalize same-sex marriage, with IIlinois' law set to take effect in 2014, making it the 16th state to do so. California witnessed the reversal of a constitutional ban on gay marriage through a series of judicial declarations and appeals that went all the way to the U.S. Supreme Court. The Supreme Court also found Section 3 of the Defense of Marriage Act to be unconstitutional, allowing legally married gay couples to receive federal marriage benefits for the first time. Enacted in 1996 Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, Section 3 barred gay married couples from recieving all federal benefits that included: joint tax returns, social security benefits, immigration, and government employee insurance benefits. In 2011, the Obama Administration announced it would no longer defend DOMA in court. On June 26th 2013, in a 5-4 decision, the US Supreme Court ruled in United States v. Windsor, that Section 3 of DOMA was unconstitutional. SECTION II. DEFINITION OF MARRIAGE. FACTS - & - THE FUTURE 8 Native American tribes have approved gay marriage since 2009. They are the Coquille Tribe, the Suquamish Tribe, the Little Traverse Bay Bands of Odawa Indians, the Pokagon Band of Potawatomi Indians, the Santa Ysabel Tribe, the Colville Tribal Council, the Cheyenne and Arapaho Tribes, and the Leech Lake Tribal Court. 6. TRIBES IN 2013 On November 20, 2013, the governor of Illinois signed a bill into law legalizing same-sex marriage. Effective June 1, 2014, marriage licenses will be available to gay couples and after a mandatory one-day waiting period, gay marriages will start. * JUNE 1 2014 New Mexico is the only state that has no law regard- ing gay marriage, neither barring or legalizing it.
