Australian Occupational Health and Safety (OHS) A Short History by Kris Diocampo LAW 1833 - 1837 1880 1883 - 1884 One of first standardising bodies is formed: the American Society of Mechanical Engineers (ASME). UK changes to OHS in response to incidents and the rise of the labor movement: First social insurance 1833 - HM Factory Inspectorate formed 1837 - Priestly v Fowler 1849 - Royal Commission on Dangerous Mining Conditions legislation (1883) and first worker's compensation law (1884) introduced in Germany by Otto von Bismarck. 1970s & 1980s 1956 1937 Robens Report is released (1972) that reviewed OHS practices in UK. Core of Australian OHS UK case of Wilsons and Australian States and Teritories adopted Robens style of OHS legislation that set out hazard & risk identification, assessment & control procedures. legislation originates from Hamilton v Nuroof (WA) Pty [1956] 96 CLR 18. The High Court held employers had a duty take reasonable care to avoid exposing workers to unnecessary injury risk. (at 25) Clyde Coal Ltd v English establishes duty of care of employer to its employees. Brundland Report is introduced with subsequent founding of the Commission for Sustainable Development (CSD) that brought ethics back into corporate governance and building safe society.
