Section 420 lays down the punishment for the offence of cheating and dishonest inducement related to property by a person.
As per the section, a person who cheats and thereby dishonestly induces the person deceived to deliver any property to any person or to make, alter or destroy the whole or any part of a valuable security shall be punished with imprisonment for a term which may extend to seven years.
Such a person shall also be liable to fine, if the Court deems fit.
A person misrepresents himself as a different person and
dishonestly induces another person to sell land to him at a lower cost. The person being cheated would have sold the land at a lower price only to the person the offender misrepresented himself as.
The first person, in such a case, can be held liable under the section for an offence. Such person can be punished with imprisonment for a period of seven years as well as a fine, if the Court deems fit.
The offence of cheating and dishonest inducement as provided for under the section is a non-bailable offence. This does not mean that a person who is under investigation for such an offence cannot get bail at all, but there are a number of factors which will be taken into consideration by the court before such bail is granted.
The offence is a cognizable offence and hence, the police can initiate a case and even make an arrest without obtaining a warrant from the Magistrate.
It is of extreme importance to take the help of a lawyer at the earliest if a case is instituted under this section.
The offence being a compoundable offence can be made to go away without having to go to court and thereby saving a lot of time, effort and money. The lawyer will also help in terms of the increased scope of interaction with the police since it is a cognizable offence and with the factors which will be taken into consideration by the court before granting bail considering how it is a non-bailable offence.
