THE IMPEACHMENT PROCESS WHAT IS IMPEACHMENT? WHO? 'The President, Vice President and all civil Officers of the United States. Impeachment is the process by which a legislative body formally levels charges against a high official of Government. It does not mean the removal from office, it is only a formal statement of charges. It is considered the first step towards removal. FOR? Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors. STEPS OF IMPEACHMENT THE OFFICIAL CHARGE Justice Department or an independent council investigates charges & presents them to the House Judiciary Committee HOUSE JUDICIARY COMMITTEE REVIEW OF EVIDENCE A standing committee of the United States House of Representatives. It oversees the administration of justice within the federal courts, administrative agencies, Federal law enforcement entities and impeachments of federal officials. House Judiciary Committee reviews evidence DRAFTS ARTICLES NIXON RESIGNED House Judiciary Committee drafts Articles of Impeachment AT THIS POINT OF HIS IMPEACHMENT DEBATES ARTICLES House Judiciary Committee (HJC) debates Articles of Impeachment. If approved, HJC conducts an investigation to determine if there is enough evidence to warrant articles of impeachment (indictments) against the President. SIMPLE MAJORITY: HOUSE DEBATES AND VOTES 218 OF 435 The entire House of Representatives votes on whether the article(s) merit a trial in the Senate with a simple majority for approval. If the full House approves at least one article of impeachment, the President is technically impeached and the matter is referred to the U.S. Senate. GERALD FORD IE THE HOUSE RULES A PRESIDENT AS IMPEACHED, IT MOVES ONTO A SENATE TRIAL SENATE TRIAL The entire House of Representatives votes on whether the article(s) merit a trial in the Senate with a simple majority for approval. If the full House approves at least one article of impeachment, the President is technically impeached and the matter is referred to the U.S. Senate. THE TRIAL House Judiciary Committee acts as the prosecution-- presents evidence against the accused THE JUDICIARY BRANCH DOES NOT TAKE PART IN THE Accused chooses own lawyers to present defense IMPEACHMENT PROCESS Chief Justice of Supreme Court acts as Judge and rules on admissibility of evidence Senate acts as the Jury CONVICT OR ACQUIT After hearing all of the evidence and closing arguments, the Senate deliberates behind closed doors then votes in open session on whether to convict or acquit the President. The vote to convict must be by a two thirds majority, or 67 Senators. If this occurs, the President is removed from office, possibly barred from any government position and is succeeded by the Vice President. The Senate's verdict is final and there is no right of appeal. ANDREW JOHNSON & BILL CLINTON ARE THE ONLY TWO PRESIDENTS TO BE IMPEACHED.
