The Litigation Process

LITIGATION When divorcing parties cannot come to an agreement on their own, the matter is taken to court. Prepare and Sign Court Documents 3 documents must be prepared: (a) The Initiating Application sets out what orders you wish the court to make, both by way of interim orders and final orders. (b) A Financial Statement if you are seeking property or spousal maintenance orders (not required in most parenting-only cases). File The three documents are filed with the Court which then fixes the matter for a preliminary hearing referred to as a Case Assessment Confer- ence or a first return date depending on whether the matter is issued in the Family Court or the Federal Magistrates Court.
