Legal Ways to Get A Divorce In the US

DIFFERENT WAYS TO DIVORCE DIVORCE IS DIFFICULT AND STRESSFUL ON ALL PARTIES INVOLVED, AND NOT ALL DIVORCES ARE THE SAME. UNCONTESTED DIVORCE An uncontested divorce is when you and spouse work together to craft the terms of a marital settlement agreement and avoid a dispute in court. DEFAULT DIVORCE A court will grant a divorce by "default" if a party files for divorce and the other spouse does not respond after being properly served with the divorce petition and other paperwork. This process may sometimes be used when a spouse's whereabouts are unknown or he or she is unwilling to participate in the divorce process. CONTESTED DIVORCE If you and your spouse cannot come to an agreement on the terms of your divorce, you can file a petition for dissolution of your marriage through the court. You will go through the process of exchanging discovery (such as financial documentation), engaging in settlement discussions, and attending hearings. If you can't come to an agreement after these activities, you will go to trial. MEDIATED DIVORCE In divorce mediation, a neutral third party, called a mediator, sits down with you and your spouse to try to help you resolve one or more of the issues in your divorce. The mediator helps you communicate with each other until you can come to an agreement. ARBITRATION In arbitration, you and your spouse agree that you'll hire an arbitrator (a private judge) to hear your case, with the resulting decision being binding.
