BILL OF RIGHTS- THE 5TH AMENDMENT Under the 5th amendment no person is allowed to bear witness against oneself or self incriminate. There cannot be any forceful interrogation and the accused person has the right to remain silent. Failure to plead the How to plead the 5th Amendment? 5th Amendment? The privilege against self incrimination can be used in a state or a federal court during the trial and proceedings. Incase the defendant fails to plead guilty anything spoken during the course of the trial, interrogation, search & other law proceedings can & will be used against them. The right against self incrimination doesn't extend to physical evidence collection like, DNA, Finger, foot prints or blood samples. The court does not protect a person who refrains from allowing DNA, hair, blood sample collections. The 5th Amendment of the Bill of Rights protects a person from self incrimination. It must be invoked at the right time to avoid further interrogation from the police or attorney.
