What Do I Testify About at My Disability Hearing? If you've been denied Social Security disability benefits at both the initial review and the reconsideration level, you may still appeal by requesting a hearing before an administrative law judge (ALJ). At the hearing, you will be required to testify regarding the extent of your impairment and the limitations that your disability has put on you and your ability to work. Either the ALJ or your disability lawyer will ask you questions pertaining to: Your background, age, and education Include vocational training. Whether or not you are fluent in English. E Whether you have any learning disabilities. Your work experience Include your previous employers, the level of exertion required at each job, the environmental limitations and hazards of each job, your skill level, how much stress was involved with each job, etc. Your medical history Substantiate it with medical records and describe your current medical treatment for your impairment. Your physical symptoms Describe your pain and its resulting restrictions on your life. Your residual functional capacity (RFC) Describe the extent of your ability to work with your impairment. Include a description of your limitations on walking, sitting, standing, lifting heavy objects, or traveling. A background and general description of your daily activities Include your typical day-to-day tasks, social or leisure activities, personal care, and how your impairment has limited each of these. Your mental symptoms, if any This is your stress tolerance and your "mental RFC," which includes your ability to: follow instructions, use your judgment, properly respond to your boss and coworkers, and adjust to changes to your workplace routine. © James Publishing
