e alleghenyattorneys.com Pennsylvania DEPARTMENT OF TRANSPORTATION Point System PennDOT keeps a driving record for every licensed driver in the state of Pennsylvania. If and when a driver has been convicted of certain moving violations, points are added to their driving record. If a driver is under the age of 18, PennDOT applies special rules when taking corrective action: > License will be suspended for 90 days if 6 or more points are accumulated. 26mph+ > License will be suspended for 90 days if convicted of driving 26+mph over the posted speed limit. > License wilu be suspended for 120 days for a second violation. PennDOT takes various corrective actions when a driver accumulates 6 or more points, and depending on the 30 Days total number of violations: > First-time offenders: The first time a driver accumulates 6 or more points, the driver must take and pass a special written point examination. If and when this test is passed successfully, 2 points will be removed after a violation-free 30-day period. IIII II. IIII .II IIII > Second-time offenders: The second time a driver accumulates 6 or more points, the driver must attend a Departmental Hearing 2nd Time where an examiner will review the driver's record. Failure to attend the hearing will result in a 60-day license suspension. After the hearing, the examiner may recommend one or more of the following: 60 Days o 15-day license suspension o Special on-road driver's examination o Take no action > Third-time offenders: The third time a driver accumulates 6 or more points, the driver must attend a Departmental Hearing where an examiner will review the driver's record and determine if a 30-day license suspension will be initiated. Failure to attend the hearing will result in a license suspension until the driver attends the hearing. 30 Days When any driver accumulates 11 or more points, the driver's license will automatically be suspended and the length of the suspension depends on how many times the license has been suspended previously, ranging from 5 days up to 1 year. SUSPENDED The only way to remove points is through safe driving. For each 12 consecutive months a driver, who is not under suspension and has not committed a violation resulting in points or suspension, 3 points are removed from their driving record. If and when point reduction arrives and remains at 0 points for 12 consecutive months, any further accumulation of points will be regard- ed by PennDOT as the first accumulation of points. If a driver's license is suspended, the driver must appeal within 30 days of receiving notice of the suspension and will be required to appear in court before their license is reinstated.
