65 percent private prisons have an occupancy rate guarantee from the government. The average occupancy guarantee rate is 90 percent. In this agreement, prisons are guaranteed an occupancy rate. When their occupancy rate rises above the guaranteed rate, the government can be hit with hefty fines. In some cases, such as Colorado, that fine can be passed onto the citizens. Since crime has dropped in the state by 30 percent, Colorado residents are now paying a “Low-crime” tax to offset these fines – to the tune of $2 million.
