The birth father has no physical or legal rights to his child if he is not married to the child's mother. Many states will only award joint custody if both parents submit a parental agreement AND the family court deems this is in the best interests of the child. There is too much room for personal biases in the family court. By insisting that every state presume parents should have joint custody, a child gets equal access to both of his parents.
