For Better or For Worse: A LOOK AT DIVORCE IN MARYLAND Grounds for Divorce NO FAULT Based on irreconcilable differences-both spouses agree the marriage is over The couple must live separate and apart for a year consecutively FAULT More involved process, but used when there are more contentious issues to resolve May be based on adultery, desertion, conviction of crimes, cruelty, and more Property Division EQUITABLE DISTRIBUTION The court will divide property from the marriage in a fair way Does not mean that the court will divide property equally DETERMINING FACTORS Include marriage length, property value, and current financial circumstances %24 Spouses agreeing on property division can settle in writing without a judge Alimony DETERMINING FACTORS Can be awarded to either spouse, based on age, marriage length, and other important factors One spouse who meets the statutory requirements may get alimony from the other TYPES OF ALIMONY Indefinite: The more difficult type of alimony to qualify for, which assumes the receiving spouse does not have the ability to become self-supporting, continues for an indefinite period, and is typically modifiable Rehabilitative: More common type of alimony which lasts for a specified period of time, with the intention of providing the receiving spouse with assistance until such time that he or she can become self-supporting, and is typically non-modifiable Child Custody CUSTODY ORDERS Involves physical custody, which is the right to have the child reside with you, as well as legal custody, which is the right to make important decisions regarding the child's upbringing Based on the best interest of the child, not the age or gender of either parent One parent may get sole custody, or both may get joint custody DETERMINING FACTORS Relationship to the child, character, child preference, and lifestyle are all considered If circumstances materially change or both parents agree, a custody order can be amended Provided By: LAW OFFICE OF KENT L.
