介 THE BAIL PROCESS IN NEW JERSEY WHAT IS A BAIL BOND? · A bail bond is money promised to a court in exchange for someone's release from jail • If this person does not show up for court dates, the bail money will be lost • A bail bond has nothing to do with a person's guilt or innocence WHO IS A BAIL BOND AGENT? A licensed individual who can pay for a defendant's release from jail A bail bond agent is available 24 hours a day New Jersey bail bond agents charge 10% of the bail amount Bail bond payments can be made: o In person o Online o By telephone A bail bond agent may ask for high-value property (collateral) to go toward bail: o Home o Car o Jewelry HOW DO BAIL BONDS WORK? 1 A person is arrested for a crime 2 A judge sets the bail amount 3 If the defendant cannot pay his bail, he must: a. Stay in jail before and during trial OR b. Have a bail bond agent post bail for him The bail bond agent meets with a family member to sign an agreement 5 The bail bond agent gives the court tho bail bond The defendant is free to loave jail, as long as he shows up to future court dates The family member, or signer, is responsible for the defendant's appearance in court 8 The defendant should keep constant, open communication with his bail bond agent If the defendant does not show up, the full bail amount will be given to the court a.
